Update on Evictions (5/19/20)
On May 14, the Supreme Court of Texas (SCOTX) issues an order allowing non-payment of rent and other evictions filings to resume on May 19th.
AATC members are encouraged to contact the Justice of the Peace court that has jurisdiction over their properties to determine the status of pending evictions and obtain court specific information for filing new evictions. Check with your JP court for hearing procedures (ion person, Zoom conference, etc.)
For information on how to contact your JP court click here.
To help our members navigate COVID-19 eviction filings, the Texas Apartment Association (TAA) has developed FAQ’s related to this order. To view TAA FAQ’s click here.
Basic Eviction Information:
- The new SCOTX eviction filing order applies statewide
- Non-payment of rent eviction trials begin May 19th
- Writs of possession may be executed beginning May 26th
- For pending cases, property owners do not have to re-start the eviction process
- Any eviction filed between March 27 and July 25th must include a “sworn petition” (affidavit, statement on the record, etc.) that the property is not subject to the federal CARES Act 120-day eviction moratorium. This statement supersedes any local JP court CARES Act affidavit requirement.
- CARES Act cover properties are still under 120-day, non-payment of rent eviction moratorium
