State Issues
AATC is the 3rd largest association of
rental housing owners and operators in Texas. Through the Texas
Apartment Association (TAA), AATC members are actively involved
in state legislative and regulatory initiatives. AATC Past
President Marlene Walker is Vice Chair of the TAA legislative
committee, and AATC President Elect Jim Whitehead serves on the
TAA Executive Committee. AATC Government Affairs Committee and
Political Action Committee Chair Mike Clark is TAA’s Affordable
Housing Committee Chair.

SB 618
– Texas Governor Perry has signed legislation (SB 618) on June
15 that increases the jurisdiction in Justice of the Peace
courts from $5,000 to $10,000. This law also includes language
that corporations do not have to be represented by an attorney
in JP courts. TAA general counsel Wendy Wilson is reviewing this
provision for potential impact on the multifamily housing
industry. It appears that this change allows onsite staffs to
represent corporate owners (not partnerships nor individuals) in
eviction suits for any/all causes. Currently, non-owner,
non-attorney onsite staffs can represent owners in Justice of
the Peace court only for cases involving non-payment of rent
and/or holding over beyond the lease term.
